This document contains the general terms and conditions for the use of https://streetcatmedia.hu/ website operated by István Sulyok ev. as service provider (hereinafter referred to as the Service Provider).

The GTC contain the procedure for the purchase of products (hereinafter referred to as the Product) that can be purchased through the website https://streetcatmedia.hu/ (hereinafter referred to as the Website) and the terms and conditions of use of the Website by the user of the Website (hereinafter referred to as the Customer).

These Terms and Conditions apply to and are valid for all Services and Products available for purchase through the Website.

The processing of the Customer's personal data is governed by the Privacy Policy.

The technical information necessary for the use of the Website, which is not included in this TOS, is provided in other information available on the Website.

The language of the contract is English.

The contract does not constitute a written contract, it is not filed by the Service Provider and therefore not accessible or viewable afterwards.

The Customer acknowledges and accepts the following by using the Website and by sending his order.

There is no registration required to buy or order on the Website.

Information on the characteristics of the product is provided on the Website under the relevant product.

During the purchase, the Customer is required to provide the following data to the Service Provider:

  • Last name

  • First name

  • Postal code

  • City

  • Street, house number

  • E-mail address

  • Phone number

You can also enter billing details if they are different from the delivery details:

  • Billing name

  • Tax number

  • Invoicing postal code

  • Invoicing city

  • Invoicing street, house number

When placing an order, the information marked with an asterisk is mandatory.

After entering the data, by ticking the box in front of the "I accept the Terms and Conditions and Privacy Policy", the Customer accepts and is bound by the provisions of these Terms and Conditions and the relevant Privacy Policy.

If the Customer has found everything to be in order with regard to the order data, he/she clicks on the Submit Order button to send his/her order to the Service Provider.

The dispatch of the order creates a payment obligation for the Customer.

If, after the order has been sent, the Customer has a need to modify the content of the order, he/she may notify the Service Provider at the e-mail address info@streetcatmedia.hu.

The Customer is entitled to request the Service Provider to delete his/her user data by sending an e-mail to info@streetcatmedia.hu. The Customer's user data will be removed from the system immediately after the deletion; however, this does not affect the retention of data and documents (e.g. invoices) related to orders already placed, nor does it result in the deletion of such data. Once removed, the data can no longer be restored.

The Service Provider shall not be liable for any delivery delays or other problems or errors resulting from incorrect and/or inaccurate data provided by the Customer.

Price of the Products

The purchase price of the Products displayed on the Website is indicated inclusive of VAT and other public charges.

The price of the Products is indicated in Euros (EUR) and the value of the order may only be settled in Euros.

The Service Provider shall not be liable for any incorrectly indicated price on the Website or for any obviously incorrect, unrealistic price (e.g. 0 EUR), which differs significantly from the generally known price of the Product (e.g. 0 EUR), despite its due diligence and/or due to a system error. In such cases, the Service Provider shall not be obliged to sell the Product to the Customer at the incorrectly indicated price on the Website. In the event of an incorrect price indication, the Service Provider shall immediately inform the Customer by e-mail that the price indicated next to the Product is incorrect and offer the Customer the opportunity to purchase the Product at the real price. In such a case, the Customer may decide to order the Product at the real price or to cancel the order without any adverse legal consequences.

Correction of data entry errors

The Customer may correct data entry errors in the ordering interface on the Website at any time during the ordering process and until the order is sent to the Supplier. Data entry errors include, for example, incorrect order data (e.g. delivery address, quantity), etc.

The Customer may report any data entry errors detected after placing the order via e-mail to info@streetcatmedia.hu.

Binding offer, confirmation

The receipt of the offer sent by the Customer will be confirmed by the Service Provider to the Customer without delay by means of an automatic confirmation e-mail, which will contain information about the order (Customer's details, address, billing and delivery details, the chosen payment and delivery method, the gross amount payable for the order, the order ID). In case of questions from the Customer about his/her order, the order ID must be referred to.

The order shall be deemed to be a contract concluded by electronic means and shall be governed by Act V of 2013 on the Civil Code, Act CVIII of 2001 on certain aspects of electronic commerce services and information society services.

If the Customer is a natural person, the contract is subject to Government Decree No. 45/2014 (26.II.) on the detailed rules of contracts between the Customer and the Service Provider and shall take into account the provisions of Directive 2011/83/EU of the European Parliament and of the Council on consumer rights.

Payment methods

After receipt of the order, the price of the product to be purchased can be paid by bank transfer or cash on delivery at the time of receipt of the product.

Invoice

The Service Provider will issue an electronic invoice to the Customer as proof of payment upon delivery of the ordered service. By carrying out the purchase transaction, the Customer gives his/her consent to the issuance of an electronic invoice by the Service Provider.

Product delivery:

The finished product will be delivered to the Customer electronically, to the email address provided by the Customer.

Right of withdrawal for natural persons:

Procedure for exercising the right of withdrawal

The provisions of this clause shall apply only to natural persons acting outside the scope of their profession, self-employed occupation or business activity who purchase, order, receive, use or make use of the Product and who are the addressee of commercial communications or offers relating to the Service (hereinafter referred to as the Consumer).

In the case of a contract for the provision of a service, the Consumer shall have the right of withdrawal without justification from the day of conclusion of the contract. If performance commences after the withdrawal, the consumer shall have the right to terminate the contract without notice within the period for withdrawal.

The burden of proving that the Consumer has exercised his right of withdrawal in accordance with the provisions laid down shall lie with the Consumer.

In both cases, the Service Provider shall immediately acknowledge receipt of the Consumer's withdrawal by e-mail.

In the case of a written withdrawal, it shall be deemed to have been validated within the time limit if the Consumer sends his declaration to this effect to the Service Provider within 14 calendar days (up to the 14th calendar day).

In the case of notification by post, the date of posting shall be taken into account by the Service Provider for the purpose of calculating the time limit, in the case of notification by e-mail, the date of sending the e-mail. The Consumer must post his letter by registered mail in order to provide credible evidence of the date of dispatch.

If the Consumer withdraws from the contract, the Service Provider shall reimburse all the consideration paid by the Consumer without delay, but at the latest within 14 days of receipt of the Consumer's notice of withdrawal.

In making the refund, the Supplier shall use the same method of payment as that used for the original transaction, unless the Consumer expressly agrees to another method of payment; no additional costs shall be borne by the Consumer as a result of the use of this method of refund.

The Consumer shall not bear all or part of the costs of the performance of the contract for the provision of the service in the event of the exercise of the right of withdrawal or termination if

  • the Supplier has failed to fulfil its obligation to provide information, or

  • the Consumer has not requested the start of the performance of the service before the expiry of the period for withdrawal or termination.

Remedies:

Place, time and manner of lodging a complaint

The Consumer may submit consumer complaints about the Product or the Service Provider's activities to the Service Provider's contact details.

The Service Provider shall send a copy of the record to the Customer at the latest at the same time as the substantive reply in the event of a verbal complaint communicated by telephone or other electronic communication service.

In all other cases, the Service Provider shall proceed in accordance with the rules applicable to written complaints.

The Service Provider shall provide the complaint recorded by telephone or other means of communication with a unique identifier, which will facilitate the subsequent tracing of the complaint.

The Service Provider will respond to the complaint received in writing within 30 days. Action shall be deemed to be posting for the purposes of this contract.

If the complaint is rejected, the Service Provider shall inform the Customer of the reasons for the rejection.

Other means of redress

In the event that any consumer dispute between the Service Provider and the Customer is not resolved in negotiations with the Service Provider, the following enforcement options are available to the Customer:

  • -lodging a complaint with the consumer protection authority,

  • -initiating proceedings before a conciliation body,

  • -initiating court proceedings.

Unilateral amendment of the Terms and Conditions:

The Service Provider is entitled to unilaterally amend these GTC by informing the Customers in advance on the Website. The modified provisions shall become effective for the Customer upon the first use of the Website after their entry into force and shall apply to orders placed after the modification.

Liability

The Customer may use the Website solely at his/her own risk and accepts that the Service Provider shall not be liable for any material or non-material damage arising from the use of the Website and the Product, in addition to liability for intentional breach of contract or for damage to human life, bodily injury or health.

The Service Provider excludes all liability for the conduct of users of the Website. The Customer is obliged to ensure that the use of the Website does not directly or indirectly infringe the rights of third parties or the law. The Customer shall be fully and exclusively responsible for its own conduct, and the Service Provider shall cooperate fully with the competent authorities in such cases in order to detect any infringements.

The Service Provider shall be entitled, but not obliged, to check the content that may be made available by the Customers during the use of the Website and the Service Provider shall be entitled, but not obliged, to look for indications of illegal activities with regard to the published content.

The Service Provider's pages may contain links to the pages of other service providers. The Service Provider shall not be liable for the privacy practices and other activities of such service providers.

Due to the global nature of the Internet, the Customer agrees that when using the Website, he/she shall act in compliance with the provisions of the applicable national laws. If any activity related to the use of the Site is not permitted under the laws of the Customer's country, the Customer shall be solely responsible for such use.

If the Customer discovers any objectionable content on the Website, he/she shall immediately notify the Service Provider. If the Service Provider, acting in good faith, finds the report to be justified, it shall be entitled to delete the information or amend it without delay.
